Copyright Law
Works such as photographs, paintings, prose, poetry, music, songs, film, plays, etc. created by humans automatically gain copyright protection as soon as they are captured in tangible form.
The copyright owner has exclusive rights to reproduce the copyrighted work, make derivative works, distribute copies of the work to the public, and display or perform public reproductions of the work.
Fair Use
The fair use exception allows for making single copies for personal, noncommercial use for specific purposes such as study, scholarship, research, or illustration for instruction.
However, fair use has limitations:
- It is not fair use to make a photocopy of a textbook instead of buying a copy, unless the material is an OER that allows for it.
- It is not fair use to use a copyrighted image on marketing materials or merchandise without permission or license.
The four factors considered in determining fair use include the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality of the portion used, and the effect of the use upon the potential market for or value of the work.
If you make a photocopy or reproduction for purposes other than those specified in the law, you may be liable for copyright infringement.
